SportsArt TikTok Campus Challenge Sweepstakes (the “Sweepstakes”) is sponsored by Sports Art America, Inc. (“SportsArt” or “Sponsor”). “SportsArt” and the SportsArt logo are trademarks of SportsArt.

THIS SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH TIKTOK.

The Sweepstakes begins on January 1, 2024, at 12:00:01 a.m., and ends on March 15, 2024, at 11:59:59 p.m. Pacific Time (the “Entry Period”)

The first 25 Entrants (defined below) to submit an Entry, as determined by Woobox (defined below), will receive a free swag bag (ARV $100); only one incentive prize per School (defined below).

Each Prize shall be awarded to Entrant’s university, college, or other higher education institution (each a “School”) for use in such School’s recreational facilities or as otherwise decided by such School.

Each Prize unit includes a standard warranty. All prizes include shipping, delivery, and set-up costs. Each Prize package must be delivered and set up in one location with adequate space and power supply for safe and efficient use of each Prize item per industry standards, as determined by Sponsor in its reasonable discretion. Delivery and setup must be completed by September 30, 2024, or such Prize will be void unless alternative arrangements are made with SportsArt. Approximate prize values are stated. If the actual value of a prize is lower than stated in these Rules, then any difference in the value will not be awarded.

SPONSOR IS NOT LIABLE FOR INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS INCLUDING PERSONAL INJURY OR DEATH, OR NON-PERFORMANCE DUE TO IMPROPER SET-UP OF A PRIZE, LOCATION OF A PRIZE, OR USE OF A PRIZE.

ALL FEDERAL, STATE, AND LOCAL LAWS AND REGULATIONS APPLY. VOID WHERE PROHIBITED OR RESTRICTED BY LAW. NO PURCHASE NECESSARY OR REQUIRED TO ENTER OR WIN. MAKING A PURCHASE WILL NOT INCREASE ODDS OF WINNING. ENTRY DOES NOT GUARANTEE ANY PRIZE. ODDS OF WINNING DEPEND UPON THE NUMBER OF ELIGIBLE ENTRIES RECEIVED.

PRIZES MAY BE SUBJECT TO TAX; ALL APPLICABLE TAXES ARE THE RESPONSIBILITY OF THE WINNER. ONLY ONE PRIZE PER WINNER. NO CASH OR OTHER SUBSTITUTIONS ARE PERMITTED, EXCEPT BY SPORTSART, WHO RESERVES THE RIGHT TO SUBSTITUTE THE PRIZE WITH ONE OF EQUAL OR GREATER VALUE. Any unspecified costs/expenses associated with acceptance and use of the Prize are each Prize Winner’s sole responsibility.

No transfer of the right to receive a Prize is permitted. Return of any Prize as undeliverable may result in disqualification and selection of alternate winners. If any Prize Winner (defined below) or such Prize Winner’s School refuses their Prize, or any portion thereof, such Prize Winner will be disqualified, and an alternate Prize Winner may be selected in accordance with these Rules at the sole discretion of Sponsor. In no event will more than the stated number of Prizes be awarded.

ELIGIBILITY
The Sweepstakes is open only to legal residents of the fifty (50) United States and the District of Columbia who are eighteen (18) years of age or older as of date of entry (each an “Entrant”) and where not otherwise prohibited by law, or where the registration or filing requirements of any state or local jurisdiction have not been complied with. Residents of Puerto Rico are not eligible.

Employees, officers, and directors of Sponsor and any parent, affiliate, subsidiary, advertising, promotion, and/or internet agencies and their immediate family members and/or those domiciled in the same household are not eligible. “Immediate family member” is defined as a parent, stepparent, child, stepchild, sibling, stepsibling, grandchild, step-grandchild, or spouse, regardless of where they reside. For purposes of eligibility, “domiciled” means people who share the same residence at least three (3) consecutive months a year, whether or not related.

Each Entrant must be enrolled at a School. No Entrant can be a member of more than one Team. There may be more than one Entrant per School.

ENTRY
ALL ENTRIES MUST BE RECEIVED DURING THE ENTRY PERIOD AND NO LATER THAN MARCH 15, 2024, AT 11:59:59 P.M. PACIFIC TIME. ALL ENTRIES MUST BE POSTED TO A PUBLIC TIKTOK ACCOUNT FOR CONSIDERATION.

First Entry: To enter, each Entrant, either as an individual or group of individuals (each a “Team”), must post to TikTok a short video stating the Entrant’s first name, School they represent, “Challenge Accepted” or stated acceptance of the challenge, and a brief description of how Entrant intends to participate in the challenge and practice sustainability on Entrant’s School campus (the “Initial Entry”). The Initial Entry must include the hashtag #SportsArtCampusChallenge and tag @SportsArtOnCampus or such Initial Entry will not be counted.

Subsequent Entries: To receive additional Entries (each a “Subsequent Entry” and together with the Initial Entry, an “Entry”), Entrant or Entrant’s Team (if applicable) may stitch any @SportsArtOnCampus TikTok stating how Entrant is living up the Challenge and creating a more sustainable campus. Each Subsequent Entry must include the hashtag #SportsArtCampusChallenge and tag @SportsArtOnCampus or such Subsequent Entry will not be counted. For purposes of Subsequent Entries, a “stitch” is a creation tool that allows a user to combine another video on TikTok with the video that user is creating.

Entrants may wear School apparel but cannot use other intellectual property without prior written consent of the intellectual property owner.

All hashtags must be exact, or an Entry will not be accepted. By participating, Entrant acknowledges and agrees to clearly and conspicuously disclose that they are participating in the Sweepstakes in any Entry or online interaction that is: i) used to obtain an Entry in this Sweepstakes or ii) otherwise references the Sweepstakes. At a minimum, such disclosure should include a reference to “@SportsArtOnCampus” in any social media communication.

TIKTOK® is a registered trademark of its owner and is used solely for purposes of description of this Sweepstakes. Such use is not intended to suggest or imply any sponsorship, endorsement or approval of this Sweepstakes by such owner.

By submitting an Entry in the Sweepstakes, Entrant agrees that SportsArt may contact Entrant via TikTok direct message, tag, or social media post, and name Entrant on SportsArt’s social media page(s) or in announcements and media related to the Sweepstakes.

Entrant must provide all information required by Sponsor to be eligible to enter and win. Only fully completed Entries are eligible.  All potential winners are subject to verification before any Prize will be awarded.

All Entries must be suitable, in Sponsor’s sole discretion, for family viewing and must not include political commentary. Sponsor reserves the right, in its sole discretion, to disqualify any Entrant whose Entry contains political commentary and/or is not suitable for family viewing, including but not limited to Entries containing nudity, graphically sexual language or imagery, drugs, alcohol, criminal activity, hate speech, or offensive language.

LIMIT ONE (1) ENTRY PER PERSON AND PER TIKTOK ACCOUNT AND/OR PER TEAM PER WEEK. FOR PURPOSES OF THIS SWEEPSTAKES, EACH SOCIAL POST SENT IN ACCORDANCE WITH THESE RULES CONSTITUTES ONE (1) ENTRY.

WINNER SELECTION

On or about March 18, 2024, three (3) Prize winners (each a “Prize Winner”) will be selected in a random drawing by Woobox LLC (https://woobox.com/), a third-party sweepstakes service (“Woobox”), from all eligible Entries received during the Entry Period and in no particular Prize-winning order (the “First Drawing”). Each Prize Winner will be notified on or about March 20, 2024, via direct message, email, or phone call using the TikTok handle, email address, or phone number used to enter or included in the Entry.

The order of Prize Winners (Grand Prize, Second Prize, and Third Prize) will be drawn out of a hat by randomly selected attendees at the NIRSA 2024 Conference in Phoenix, Arizona on April 20, 2024, and will be publicly announced. In addition to the public announcement made at the NIRSA 2024 Conference, Prize Winners will be notified of the Prize package won on or about April 20, 2024, via direct message, email, or phone call using the TikTok handle, email address, or phone number used to enter or included in the Entry.

SportsArt must receive from each Prize Winner’s School within ten (10) days of being selected as a Prize Winner in the First Drawing, an affidavit from an authorized representative of the School: (a) providing permission from such School to use the School’s name and logo for promotion in relation to the Sweepstakes, and (b) affirming that the Prize will be accepted by September 30, 2024 and installed in one location on the School’s campus. IF A PRIZE WINNER’S SCHOOL FAILS TO CONSENT OR PROVIDE AN AFFIDAVIT, THEN SUCH PRIZE WINNER WILL NOT BE CONSIDERED IN THE FINAL ROUND AND ANOTHER PRIZE WINNER WILL BE SELECTED.

If any Prize Winner fails to claim their Prize by September 30, 2024, and alternative arrangements are not made with SportsArt, or if any Prize Winner’s School fails to accept their Prize, a new Prize Winner will be selected in a random drawing from the remaining eligible Entries received during the Entry Period.

ALL POTENTIAL WINNERS ARE SUBJECT TO VERIFICATION BY SPONSOR, WHOSE DECISIONS ARE FINAL AND BINDING IN ALL MATTERS RELATED TO THIS SWEEPSTAKES. NO ENTRANT IS A WINNER OF ANY PRIZE UNLESS AND UNTIL NOTIFIED BY SPONSOR.

OBTAINING WINNERS LIST AND OFFICIAL RULES
Sweepstakes results and/or a copy of these Rules may be obtained by emailing [email protected] and including in the subject line, “Request for Sweepstakes Rules,” “Request for Results of Sweepstakes,” or “Request for Rules and Results,” and specifying both the name and date(s) of the Sweepstakes in either the subject or body of the email. When a request is received by email, the requested information will be sent via email. Alternatively, where permitted by law, you may send a self-addressed, stamped envelope to SPORTS ART AMERICA, INC., 8217 44TH AVE W, #A, MUKILTEO, WA, 98275., Attn: Campus Challenge, and specify in the request whether you are requesting the rules, results, or both, and the name of the Sweepstakes and the date(s) it was held.

GENERAL RULES & LIMITATIONS
By participating in the Sweepstakes, each Entrant fully and unconditionally agrees to be bound by and accepts these Rules and the decisions of Sponsor (including without limitation, decisions regarding eligibility of entries, the selection of Entrants and the winners, and the awarding of any Prize), which are final and binding in all respects. Entry and acceptance of a Prize constitute permission for Sponsor and its agencies to use each winner’s name, Prize won, School, and likeness for online posting, and any other promotional or trade purposes, including a winner’s list, without further compensation, except where prohibited by law. All decisions by Sponsor regarding this Sweepstakes are final.

By participating in the Sweepstakes, Entrant agrees to adhere to TikTok’s terms of service. Each Entrant represents and warrants that they (i) have written and signed consent from any individual(s) appearing in their Entry to appear in the Entry and for any commercial re-use that Sponsor makes of the Entry; (ii) have written consent or a license to use any third-party content used in their Entry; (iii) have used royalty-free music only in their Entry; and (iv) will use only original material or material for which they have the written permission from the creator/owner in their Entry.

By entering, Entrant agrees to be notified using the contact information provided as part of entry by SportsArt for the purposes of administration of the Sweepstakes.

In the event there is a discrepancy or inconsistency between disclosures or other statements contained in Sweepstakes materials and these Rules, the English version of these Rules shall prevail, govern, and control. Sponsor is not responsible for any typographical or other error in the printing of the offer, administration of the Sweepstakes or in the announcement of the Prizes.

Sponsor may prohibit an Entrant from participating in the Sweepstakes if, in its sole discretion, Sponsor determines said Entrant is attempting to undermine the legitimate operations of the Sweepstakes by cheating, hacking, deception, or other unfair practices, or intending to annoy, abuse, threaten, or harass any other Entrants or Sponsor and their agents.

In the event Sponsor is prevented from continuing this Sweepstakes, or the integrity and/or feasibility of the Sweepstakes is undermined by any event including, but not limited to, fire, flood, epidemic, earthquake, explosion, labor dispute or strike, act of God or public enemy, satellite or equipment failure, riot or civil disturbance, war (declared or undeclared), terrorist threat or activity, or any federal, state, or local government law, order, or regulation, order of any court or jurisdiction, or by other cause not reasonably within Sponsor’s control (each a “Force Majeure” event), Sponsor shall have the right, in its discretion, to abbreviate, modify, suspend, cancel, or terminate the Sweepstakes without further obligation. If Sponsor, in its discretion, elects to abbreviate the Sweepstakes as a result of a Force Majeure event, Sponsor reserves the right, but shall have no obligation, to award the Prizes among all valid and eligible Entries received up to the time of such Force Majeure event.

By participating, Entrant agrees that all Entries posted in connection with the Sweepstakes, including all rights embodied therein, with the exception of non-public personal data as identified in SportsArt’s Privacy Policy, are deemed to be non-confidential and non-proprietary and Sponsor shall have no obligation of any kind with respect to such Entry. Entrant explicitly acknowledges and agrees that Sponsor and its legal representatives, successors and assigns, and those acting pursuant to their authority, shall have the irrevocable, worldwide right in perpetuity to license, edit, alter, post, reproduce, publicly display and publish, in any media, including online, any or all material which Entrant uploads to any websites (including, without limitation, social media sites) associated with the Sweepstakes, with or without first and/or last name credit to the Entrant and without any additional consideration or approvals from or to Entrant; and Entries that attempt to restrict this right will not be eligible. Entrant hereby grants to Sponsor and its legal representatives, successors and assigns, an irrevocable, and world-wide license to use, exploit, publish, use, disclose, disseminate and distribute in perpetuity any winning Entry in any form or format and to modify, edit, or reproduce the same, and acknowledges and agrees that if Sponsor uses the Entry, Entrant shall not be entitled to any credit, consideration, notice or payments of any kind. Upon request from Sponsor, Entrant will execute any documents requested to evidence this license. Entrant agrees that if Sponsor elects to use any winning Entry for any purpose, all rights under copyright or other intellectual property rights which may result from that relating to Entrant’s Entry or from use of the same by Sponsor shall be the sole property of Sponsor, respectively. Entrant agrees to indemnify Sponsor and its agents, employees, affiliates, subsidiaries, representative and all related parties from and against any and all damages, costs, judgments, and expenses (including reasonable attorney fees) which they incur as a result of Sponsor’s use of Entrant’s Entry.

LIMITATION OF LIABILITY AND RELEASES

 By participating, Entrants agree that Sponsor, TikTok, and their affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, website providers, web masters, and their respective officers, directors, employees, representatives, and agents (the “Released Parties”) are not responsible for:

(1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind; (3) unauthorized human intervention in any part of the entry process; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of Entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any Prize.

BY PARTICIPATING, ENTRANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY ENTRANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ENTRY OR PARTICIPATION IN THIS SWEEPSTAKES, ACCEPTANCE, POSSESSION, MISUSE, OR USE OF THE PRIZE, OR ANY OTHER SWEEPSTAKES RELATED ACTIVITY, INCLUDING ACCESS TO AND USE OF THE INTERNET SITE GOSPORTSART.COM OR THE DOWNLOADING FROM AND/OR PRINTING MATERIAL DOWNLOADED FROM SAID SITE OR MOBILE APP, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY.

EXCEPT AS OTHERWISE PROVIDED IN THESE RULES AND WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS SWEEPSTAKES, INCLUDING ALL PRIZES, ARE PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. SOME JURISDICTIONS MAY NOT ALLOW THE LIMITATIONS OR EXCLUSIONS OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES OR EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE LIMITATIONS OR EXCLUSIONS MAY NOT APPLY. CHECK LOCAL LAWS FOR ANY RESTRICTIONS OR LIMITATIONS REGARDING THESE LIMITATIONS OR EXCLUSIONS.

This Sweepstakes is governed by the laws of the United States. Except where prohibited, Entrant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate United States District Court or State Court; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes not to exceed $50 USD, but in no event attorneys’ fees; and (3) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.

All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, or the rights and obligations of the Entrant, and Sponsor in connection with this Sweepstakes, shall be governed by, and construed in accordance with, the laws of the State of Washington, without giving effect to any choice of law or conflict of law rules (whether of the State or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of Washington.

PRIVACY
SportsArt collects information from Entrants when they enter the Sweepstakes and this information is subject to SportsArt’s Privacy Policy, which can be found at https://www.gosportsart.com/company/philosophy/policies. Each Entry in the Sweepstakes represents acknowledgment that SportsArt’s Privacy Policy applies to the information SportsArt collects from Entrant as a result of the Sweepstakes. If applicable, Entrants may opt-out of marketing and promotional communications from SportsArt’s affiliates, marketing partners, and supplier partners by contacting SportsArt at the address below or visiting the Privacy Policy web page included here and choosing one of the options related to managing Entrant’s information. Entrants also acknowledge that TikTok is a third-party platform with its own Privacy Policy, which can be found at https://www.tiktok.com/legal/page/us/privacy-policy/en?lang%3Den=.
